These Terms of Service govern access to the SeaMotion website and the purchase and use of our water-sports and outdoor-leisure products, content, communications, and related services.
By visiting the website, creating an account, submitting information, or placing an order, you agree to these Terms and to the policies referenced in them. Do not use the website or place an order if you do not agree.
Agreement overview
SeaMotion provides products and information for paddling, swimming, snorkeling, tow sports, beach recreation, pool leisure, safety, storage, transport, repair, and equipment care. These Terms explain the responsibilities that apply when using our website and services.

Inspect, assemble, transport, maintain, and use every product according to instructions, local rules, conditions, and personal ability.

Product information supports selection, but customers remain responsible for checking fit, compatibility, intended use, and local requirements.
Eligibility, access, and accounts
You must be legally capable of entering a binding agreement in your jurisdiction. A minor may use the website only with the involvement and permission of a parent or legal guardian who accepts responsibility for the minor’s activity.
Commerce terms
Product listings invite customers to submit an order. An order becomes accepted only when SeaMotion confirms acceptance or dispatches the product, subject to payment, verification, inventory, delivery coverage, and fraud-prevention review.
We aim to present product titles, descriptions, dimensions, colors, images, specifications, compatibility, and availability accurately. Screen settings, photography, manufacturing updates, and ordinary variation can affect appearance. Products and quantities may change without notice.
SeaMotion may limit quantities, request additional information, correct obvious errors, decline suspicious transactions, or cancel an order that cannot be fulfilled. If payment has been collected for a canceled unshipped order, the applicable amount will be refunded.
Prices are displayed in U.S. dollars unless stated otherwise. Applicable sales tax is calculated during checkout. We may correct pricing, description, or calculation errors before accepting an order and will provide an appropriate choice when a material correction affects a submitted order.
You authorize the selected payment provider to charge the order total and applicable taxes. Payment information may be processed by third-party payment services. SeaMotion may require successful authorization before an order is prepared or shipped.
Email subscribers receive an automatic 15% sitewide discount after successful subscription, without a code and without a first-order limitation. Selected promotional products may receive an automatic 20% discount. Eligibility, exclusions, timing, and combination rules displayed with an offer form part of that promotion.
SeaMotion provides free standard shipping on eligible U.S. orders and estimates delivery within 3–5 calendar days under normal conditions. Delivery dates are estimates. If shipment cannot occur within the stated time, SeaMotion will provide the legally required delay, cancellation, and refund options.
Eligible products may be returned or exchanged within 30 calendar days after delivery, with free approved standard return shipping and no restocking fee. Authorization, condition, hygiene, packaging, completeness, and product-specific requirements apply.
By using the website or placing an order, you consent to receive order confirmations, payment notices, security messages, shipping updates, policy notices, and customer-service communications electronically. Marketing communications are governed by the choices provided with them.
Outdoor equipment responsibility
Water sports and outdoor recreation involve changing conditions and inherent risks, including drowning, collision, falls, weather exposure, currents, equipment failure, and injury. No product, instruction, description, or safety accessory removes every risk.
Customers are responsible for selecting conditions, routes, equipment, supervision, and instruction appropriate to the activity.
Acceptable use rules
Website access is provided on the condition that it is not used to harm SeaMotion, other visitors, service providers, intellectual property owners, or the integrity of the online service.
Do not bypass security controls, test vulnerabilities without permission, obtain restricted data, use another person’s credentials, or interfere with authentication, checkout, payment, or fraud-prevention systems.
Do not upload malware, automate excessive requests, scrape protected content, overload infrastructure, interrupt service, reverse engineer restricted technology, or introduce code intended to damage or monitor users.
Do not place fraudulent orders, use unauthorized payment methods, manipulate promotions, conceal resale activity, create false accounts, interfere with inventory, or exploit obvious pricing or technical errors.
Do not submit content that is false, misleading, defamatory, threatening, obscene, discriminatory, infringing, deceptive, commercially unauthorized, or otherwise unlawful.
Do not misrepresent identity, authority, affiliation, product experience, order status, ownership, endorsement, or the source of a review, message, image, or other submission.
Do not use the website or products in violation of consumer, payment, privacy, intellectual-property, export, sanctions, safety, environmental, boating, waterway, or other applicable requirements.
Safety information, organized equipment, and responsible use remain essential before every water-based activity.
Content, ownership, and submissions
The website and its design, text, graphics, logos, photographs, product presentation, icons, videos, software, arrangement, and other content are owned by SeaMotion, its licensors, or applicable rights holders and are protected by intellectual-property laws.
Legal framework
The provisions below allocate responsibility for website access, third-party services, unexpected events, and claims while preserving rights that cannot legally be waived.
The website may use or link to payment processors, carriers, analytics tools, social platforms, embedded media, and other external services. SeaMotion does not control every third-party service and is not responsible for its independent content, availability, security, terms, or privacy practices.
To the fullest extent permitted by law, the website and general informational content are provided on an “as available” basis. SeaMotion does not promise uninterrupted access, error-free operation, or that general content will be suitable for every activity, location, user, or condition.
Products may include warranties supplied by their manufacturer. Except for warranties expressly stated in writing and rights that cannot be excluded, SeaMotion disclaims implied warranties to the fullest extent permitted by applicable law.
To the fullest extent permitted by law, SeaMotion will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from website use, delayed access, third-party services, or product use. Any limitation applies only where lawful and does not exclude liability that cannot legally be limited.
To the extent permitted by law, you agree to defend, indemnify, and hold SeaMotion harmless from claims, losses, liabilities, and reasonable costs arising from your unlawful website use, breach of these Terms, infringement of another person’s rights, or misuse of a product.
SeaMotion is not responsible for delay or failure caused by events beyond reasonable control, including severe weather, natural disasters, carrier interruption, labor disruption, utility failure, cyber incidents, government action, public emergencies, or supply and transportation constraints.
SeaMotion may suspend or terminate website access, cancel affected orders, or take protective action when these Terms are violated, fraud or misuse is suspected, security is threatened, or continued service would create legal or operational risk.
These Terms are governed by the laws of the State of North Carolina and applicable federal law, without limiting any mandatory consumer protection that applies in your place of residence. Disputes may be brought in a court with lawful jurisdiction.
If a provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue. A delay in enforcing a provision does not waive the right to enforce it later.
You may not transfer rights or obligations under these Terms without SeaMotion’s written consent. SeaMotion may assign these Terms as part of a merger, reorganization, sale, financing, service transfer, or other lawful business transaction.
These Terms, together with the Privacy Policy, Cookie Policy, Shipping Policy, Return & Refund Policy, and any product-specific or promotional terms presented before purchase, form the agreement governing the relevant website use and transaction.
SeaMotion may update these Terms to reflect legal, operational, technical, product, or service changes. The revised date will be displayed at the top. Changes apply prospectively unless applicable law requires otherwise.
Nothing in these Terms limits rights or remedies that cannot be waived under applicable law. If a product-specific written term conflicts with a general provision here, the more specific term controls for that product or transaction to the extent permitted by law.
